1. Vad är yttrandefrihet?

Yttrandefrihet innebär att alla i samhället kan uttrycka sina åsikter, ge upplysningar, debattera och diskutera. Det kan exempelvis göras genom att prata, hålla ett tal, ha kläder, eller bära en skylt. Medier, alltså exempelvis tryckta skrifter, radioprogram, TV och webbsidor med utgivningsbevis, har ett extra starkt skydd i Sverige. Yttrandefriheten sägs ofta vara grunden för ett demokratiskt samhälle.
2 Vilka lagar bestämmer yttrandefriheten?

Yttrandefriheten är en grundläggande rättighet och det innebär att den finns beskriven i Sveriges grundlagar. I Regeringsformen finns de allmänna reglerna som faller in när inget annat tillämpas. Därtill kommer Tryckfrihetsförordningen som innehåller regler om tryckta skrifter och Yttrandefrihetsgrundlagen som handlar om radio, tv, film och vissa databaser. Inskränkningar i yttrandefriheten finns också i Brottsbalken och i Offentlighets- och sekretesslagen.



3 Vad får jag inte uttrycka i Sverige?

Ytterst är yttrandefriheten totalt fri, men i praktiken finns inskränkningar, vilka kan delas in i tre grupper. Den första är skyddet för individer. Här hamnar ärekränkning, när den person som man yttrar sig om uppfattar yttrandet som kränkande. Det kan också vara förtal, vilket innebär att det som uttrycks uppfattas som kränkande av en stor grupp. Den andra delen är skyddet för grupper. Här hamnar exempelvis hets mot folkgrupp, alltså kränkande uttalanden om grupper. Det kan handla om religion, sexualitet eller etnicitet. Den tredje delen gäller skydd av staten, vilket är mest aktuellt i krigstid. Här hamnar exempelvis spioneri, högförräderi och uppvigling till brott.


 
4 Vilket skydd har den som hör av sig till en redaktion med en känslig uppgift?

Uppgiften behöver inte vara känslig. Alla har ett meddelarskydd. Meddelarskyddet innehåller flera olika dimensioner. Det ena är att man överhuvudtaget får lämna en uppgift till media. En annan del är att redaktionen har tystnadsplikt. Det är straffbart för journalister att avslöja varifrån en uppgift kommer om källan vill vara anonym. Det finns också ett skydd på arbetsplatsen mot efterforskning, vilket betyder att chefer i offentlig verksamhet inte får fråga efter vem som lämnat en uppgift.



5 Vilka rättigheter har jag som anställd att tipsa en redaktion om något jag tycker är fel?

Det beror på var man jobbar. Alla har en meddelarfrihet. Men den som är offentligt anställd har också rätt att lämna ut hemliga uppgifter till journalister. Om man är privatanställd är det inte riktigt lika enkelt. På redaktionen gäller samma skydd, journalisten får inte avslöja sina källor. Däremot finns det i normalfallet inga hinder för arbetsgivaren att fråga vem som spridit information. Inom privat sektor kan lojalitetsplikten mot arbetsgivaren vara så stark att man får sparken om det kommer fram att man lämnat uppgifter till media. Det är dock ovanligt. I normalfallet tar domstolen hänsyn till att det är fundamentalt i ett demokratiskt samhälle att kunna yttra sig. Inom offentlig verksamhet kan det vara ett brott att avslöja statshemligheter eller liknande.


6 Vad kan jag göra om radion sänder något jag inte vill ska sändas?

Först och främst bör man kontakta redaktionen. Om det inte det fungerar finns det andra vägar. När det gäller radio finns möjligheten att väcka åtal mot den som är ansvarig utgivare. Det finns också en granskningsnamnd för radio och tv som kan kritisera det som har sänts. För tidningar gäller ungefär samma sak. Där finns Pressens opinionsnämnd som uttalar sig och kan ta ut en avgift av tidningar som gjort fel. Vad gäller det som publiceras på internet ser det olika ut. Om det finns en ansvarig utgivare är det klart vem som ansvarar. Men många webbsidor har ingen tydlig avsändare och då finns det inte mycket att göra.


7 Hur skiljer sig vår yttrandefrihet i Sverige från andra länders?

Den svenska yttrandefriheten är särskilt skyddad jämfört med hur det ser ut i de flesta andra länder. I Sverige finns två grundlagar speciellt för yttrandefrihet: Tryckfrihetsförordningen och Yttrandefrihetsgrundlagen. De innehåller detaljerade bestämmelser om vilka brott som begås. Det är generellt svårt att bli fälld för ett yttrandefrihetsbrott i Sverige jämför med andra länder. På en del håll i världen censurerar staten det som publiceras i tidningar och massmedier. Det ses som ett brott mot staten att kritisera regeringen. Så har vi det inte längre i Sverige.



8 Hur har internets inträde påverkat yttrandefriheten?

För 20 år sedan kan man säga att yttrandefriheten kontrollerades av tidningar, radio och tv. I och med internet kan vem som helst sprida sina åsikter och idéer. Det gör att katalogen och bredden av åsikter blir vidare. Samtidigt har makten över yttrandefriheten delvis förskjutits från staten i och med att stora företag som Google, Facebook och Youtube i viss mån kontrollerar vad som sägs på nätet. Eftersom de är verksamma i många länder är det ofta svårt att definiera var ansvaret ligger.


9 Är det censur om en redaktion inte publicerar min insändare i tidningen eller plockar bort en kommentar som jag skrivit på deras webbsida?

Den snäva definitionen av censur och som finns i Yttrandefrihetsgrundlagen och Tryckfrihetsförordningen är att staten lägger hinder i förväg för att man publicerar något. Eftersom det är redaktionen som är ansvarig för det som finns i kommentarsfältet eller för vilka insändare som publiceras har den ansvarige utgivaren självklar rätt att bestämma vad som ska finnas med. I vissa fall har han eller hon också en skyldighet att ta bort kommentarer. Så nej, det är inte censur. Om man tycker att det är fel att redaktionen tar bort en kommentar är lösningen att starta en egen webbsida och publicera sig där.


10 Får jag skriva på nätet att min kompis är ett vidrigt avskum?

Det man inte kan säga till någon direkt ska man inte heller skriva på nätet. En del i yttrandefrihetsbrotten handlar om hur spridda de är. Det är en förmildrande omständighet om man i sociala medier tror att man skriver i en sluten grupp, som sedan visar sig vara öppen. Eller att kommentaren sprids på något sätt som man inte förutsett. Då tar domstolen hänsyn till att man inte haft för avsikt att kommentaren skulle spridas i stora kretsar. Om man skriver i ett forum som är allmänt tillgängligt är det genast allvarligare. Just den här formuleringen kan vara ärekränkning, alltså att den person man skriver om uppfattar det som kränkande. Det är dock inte säkert att det skulle leda till åtal eller att den som skrivit en liknande kommentar skulle fällas i en rättegång. Det kan finnas förmildrande omständigheter.

1. What is freedom of expression?
 
Freedom of speech means that everyone in the community can voice their opinions, provide information, debate and discuss. This can be done by talking, give a speech, have clothes, or wear a sign. The media, therefore, such as print publications, radio, television and web pages with the publication authorization, has an extra strong protection in Sweden. Freedom of expression is often said to be the foundation of a democratic society.
2 Which laws determine freedom of speech?
